تلقت منظمة الدفاع الدولية المعلومات حول قضية اعتقال عضو منظمة الدفاع الدولية السيد مروان العش، عضو المجلس الوطني لاعلان دمشق، الخبر الذي نجم عنه قلق كبير لدى نشطاء حقوق الانسان في جميع انحاء العالم.

 تستنكر منظمة الدفاع الدولية هذا الاعتقال التعسفي وتطالب بالافراج الفوري عنه اذ انه اعتقل فقط بسبب ارائه وانشطته السلمية.
وتشجع على الانضمام الى هذه الحملة المعلنة ضد عمليات استهداف  النشطاء.

القضية:

علمت منظمة الدفاع الدولية من الاخبار الواردة من نشطاء منظمة الدفاع الدولية واعضاء شبكة الدفاع الدولية بان السلطات السورية، متمثلة في فرع الأمن الداخلي التابع لإدارة أمن الدولة، اعتقلت في 15 يناير 2008 عضو منظمة الدفاع الدولية المهندس والنقابي مروان العش، عضو المجلس الوطني لاعلان دمشق.

ويُعتقد ان توقيفه يرجع الى مشاركته في الإجتماع الموسع الذي دعت إليه الأمانة العامة لإعلان دمشق وذلك بتاريخ 1 ديسمبر2007 وبانه محتجز الان بمعزل عن العالم الخارجي مما يضعه فى خطر التعرض للتعذيب او غيره من ضروب سوء المعاملة.

رأي ومطالب منظمة الدفاع الدولية:

تستنكر منظمة الدفاع الدولية استهداف أعضاء المجلس الوطني لاعلان دمشق وهم: الدكتورة فداء أكرم الحوراني والكاتب أكرم البني والدكتور أحمد طعمة والدكتور وليد البني والأستاذ محمد حجي درويش والأستاذ فايز سارة والدكتور ياسر العيتي والأستاذ جبر الشوفي والأستاذ علي العبد الله والأستاذ مروان العش.

نجم عن اعتقال عضو منظمة الدفاع الدولية المهندس والنقابي مروان العش قلقا كبيرا لدى نشطاء حقوق الانسان في جميع انحاء العالم.

تدعو منظمة الدفاع الدولية السلطات السورية الى الافراج الفوري عن عضو منظمة الدفاع الدولية المهندس والنقابي مروان العش ـ الافراج عنه دون اي قيد او شرط ، الا اذا كان قد اتهم بتهمة ما، حينها نطالبهم بضمان محاكمة عادلة وسريعة.

ونحث السلطات السورية على توفير الضمانات الفورية بان السيد مروان لن يتعرض للتعذيب أو لاي نوع من انواع سوء المعاملة، وذلك لكون سوريا دولة طرف في اتفاقية الامم المتحدة لمناهضة التعذيب.

للسيد العش الحق بالاتصال الفوري بمحامي يختاره هو بنفسه وله الحق ايضاً في اللقاء بأسرته ولتلقي اي علاج طبي قد يكون بحاجة اليه.

وعلاوة على ذلك فان منظمة الدفاع الدولية تؤكد بان السيد مروان هو سجين رأي، اعتقل لمجرد تعبيره السلمي عن ارائه تماشياً مع الحقوق الاساسية للانسان كحرية التعبير وحق التجمع وتشكيل الجمعيات. وبما انه عضو في منظمة الدفاع الدولية فهو مدافع عن حقوق الانسان.

نأمل ان تضمن  السلطات السورية بان جميع النشطاء في سوريا سيكونون قادرين على مواصلة نشاطاتهم السلمية والمشروعة دون خوف من ان يصبحوا عرضة للاعتقال التعسفي او التعذيب او سوء المعاملة او غيرها من انتهاكات حقوق الانسان.
حالات المضايقات والتخويف والاعتقالات هذه ما هي الا انتهاك مباشر للحق في حرية التعبير وحرية التجمع، على النحو المنصوص عليه في العهد الدولي الخاص بالحقوق المدنية والسياسية، والذي سوريا دولة طرف فيه، وكذلك انتهاك لاعلان الامم المتحدة بخصوص المدافعين عن حقوق الانسان، الذي اعتمدته الجمعية العامة للامم المتحدة في كانون الاول/ديسمبر 1998. هذا الاعلان يضع الخطوط العريضة لواجب الدول في اتخاذ جميع التدابير اللازمة لحماية النشطاء من العنف والاجراءات التعسفية.

We are concerned that he is detained incommunicado, where torture is most frequently practiced according to the UN Special Rapporteur on Torture. I urge you to provide immediate guarantees that Mr. Marawan Al-Ish is not being tortured or otherwise ill-treated.

Furthermore I would like to point out that Mr. Marawan Al-Ish is a prisoner of conscience, arrested solely for the peaceful expression of his opinions in line with his fundamental human rights to freedom of expression and association. I call on you to release him immediately and unconditionally unless he is charged with a recognizably criminal offence.

It is my hope that Your Excellency will ensure that all activists in Syria would be able to conduct their peaceful and legitimate human right activities without fear of arbitrary detention, torture or ill-treatment or other human rights violations.

I wish you to remind the authorities that Mr. Marawan Al-Ish has the right to immediate and unrestricted access to his family, a lawyer, and any medical treatment he may need.
